HC: Delay can’t be ground for dismissal of sex abuse plaint | Kolkata News – Times of India

KOLKATA: Delay can’t be grounds for dismissing a sexual abuse complaint since such complaints are normally filed after a lot of thought, after having overcome fear for one’s self, of the future, of society, and, finally, the stigma attached, the Calcutta high court said on Friday, reports Saibal Sen.
It was hearing an appeal by a professor and a research scholar of Kalyani University for quashing of a police chargesheet naming them in a sexual abuse complaint by a student. The HC dismissed their plea.
Justice Shampa Dutt (Paul) questioned the finding of the university’s internal complaints committee that faulted the MPhil student for not immediately reporting the complaint against professor and research scholar to the department head and instead confiding in friends. “In such cases, friends are taken into confidence first,” the judge said.
The student first submitted a complaint to the KU VC on November 9, 2017. Later, she sent another complaint to the registrar. In March 2018, a third complaint was sent to the ICC presiding officer. On March 21, 2018, she wrote to the Bengal governor and the state education minister. Thereafter, the ICC took up her complaint and, on July 2, 2018, acquitted the professor and research scholar of all charges. Not only did the ICC dismiss her charges, it also penalised her. The HC ruled that the ICC’s findings were “illegal and irregular” and the complainant had not received “fair treatment”.
