On April 6, NGT’s east zone bench in Kolkata had warned the principal chief conservator of forests (wildlife) and chief wildlife warden, Odisha, Sushil Kumar Popli, that it will proceed under Section 26 of the NGT Act, 2010, if the elephant corridors in the state are not notified within a month.
The tribunal’s ultimatum assumed significance as Section 26 of the NGT Act prescribes punishment by way of imprisonment up to a maximum three years or fine, which may extend to Rs 10 crore, or both.
For continuance of the failure after conviction for first such failure, it prescribes an additional fine, which may extend to Rs 25,000 for each day. The HC issued the stay order on the petition the state government had filed seeking intervention against the tribunal’s April 6 order.
When the petition came up on Thursday, advocate general Ashok Kumar Parija pointed out that the tribunal had issued the ultimatum even as it was very much aware that the HC was apprised of the same issue for notification of elephant corridor in a PIL.
The next date of hearing on the PIL is the same as the NGT has listed the matter on (May 9), Parija said.
Taking note of it, the two-judge bench of Chief Justice S Muralidhar and Justice Gourishankar Satapathy said, “…It is not desirable, therefore, that there should be parallel proceedings both in the NGT and this court on the same issue.”
