NEW DELHI: Reflecting the ongoing war between telecom service providers to retain and add subscribers, Reliance Jio on Monday complained to the Supreme Court that the telecom appellate tribunal erroneously barred its role in the case by Vodafone-Idea and Airtel challenging DoT’s decision to impose Rs 3,050 crore penalty on them.
Appearing for Reliance Jio, senior advocate Ramji Srinivasan told a bench of Chief Justice N V Ramana and Justices Krishna Murari and Hima Kohli that Reliance Jio was the complainant against Vodafone-Idea and Airtel before Telecom Regulatory Authority of India (TRAI), accusing them of unfair practices which had resulted in call drops from Jio network to the networks of other two service providers.
TRAI had inquired into Jio’s complaint and had recommended action against Vodafone-Idea and Airtel. The department of telecom (DoT) had accepted TRAI’s recommendations and imposed a penalty of Rs 3,050 crore on the two service providers.
When Srinivasan argued that “how could the complainant be kept out of the proceedings arising out of the complaint”, the CJI-led bench issued notice to the respondents on Jio’s special leave petition challenging the decision by the Telecom Disputes Settlement and Appellate Tribunal (TDSAT).
Jio had complained to TRAI that Vodafone-Idea and Airtel had wilfully denied adequate points of interconnection to Reliance Jio in 2016, as a consequence of which Jio subscribers suffered call failures to the tune of 10.2 crore every day during that period.
After the DoT on September 29 last year imposed penalty on the two service providers, they had challenged it before TDSAT, which on November 23 last year had stayed the realisation of the penalty amount of Rs 3,050 crore from them.
